PRIVACY POLICY

Pacific Residential Mortgage (PRM) makes it a priority to protect the confidentiality and privacy of all consumer information. PRM does not share this information with other third parties, except as necessary to originate and close home mortgage transactions or as required by law. For purposes of defining who is covered within this Privacy Policy, the terms customer, consumer, client, applicant and borrower are interchangeable and are referred to collectively.
The Gathering of Customer Information
The process of providing financial products and services requires the acquisition of private information from customers. The collection of information is at all times gathered for the express purpose of obtaining credit approval and shall be limited to the required amount, or anticipated amount, of information necessary. At the time of the application process, the Privacy Notice shall be presented to the applicant. For those transactions in which the application is not taken in a face-to-face meeting, but is, for example, taken by phone or via the Internet, the Privacy Notice shall be disclosed to the customer via mail within three days of confirmation that an application for credit approval has been made. The information may be gathered in the following ways:
- Information Provided by Applicant(s): Loan applications, forms, income and asset documentation, and other information provided by the customer over the telephone, electronically, or by any other means. This information may include residence history, payment history, account usage, or account balances.
- Information Provided by Third Parties: This information may include account information and information about the client's credit worthiness, such as:
- Information from public sources: This includes real estate records, telephone numbers, public records, etc.
- Information provided by current and past employers.
- Information gathered from necessary third parties, such as title companies, credit reporting agencies, financial institutions (that the client has a relationship with), fraud monitoring companies, etc.
Information We Share: PRM may disclose information about customer(s) as is permitted by law. PRM is lawfully permitted to do so, without client consent, in response to the following circumstances:
- Requests by regulatory authorities and law enforcement officials
- To Protect against or prevent actual or potential fraud, unauthorized transactions, claims, or other liability
- To report account activity to credit bureaus
- To report to consumer reporting agencies
- To respond to a subpoena, court order, or judicial process
- In connection with a proposed or actual sale, merger, or transfer of all or a portion of PRM or an operating unit, etc.
Additionally, PRM may provide information about the client to its service providers to aid in the processing of applications or to appropriately service the transaction.
PRM may also provide information about the client to its service providers to perform marketing services. The information PRM may give to these service providers includes information described under the "The Gathering of Customer Information" section of this privacy statement. It is limited to only that which PRM deems appropriate for these service providers to carry out their functions and will not be used by third parties for their own independent marketing efforts. Any information that is shared for marketing efforts will be limited to publicly available information, such as name, address, loan amount, loan type, etc. and shall not include private information, such as social security numbers, account numbers, etc.
Opting Out Applicants may Opt Out of any sharing of their information, whether private or public, to any third parties with which PRM may, from time to time, be affiliated. This is in addition to the fact that it is not PRM policy to share this information with third parties except for those purposes expressly identified within this document. PRM does not currently, and will not at a future date, sell customer information to a third party other than in conjunction with the sale of closed mortgage loan transactions. An applicant may opt out by signing the privacy policy notice at the time the application is taken, or anytime after. However, no private information is shared with any third parties outside of the verification requirements of the loan transaction itself.
How PRM Protects Customer Information PRM actively takes measures to protect all consumer information that it collects. These include:
- No selling of consumer information to third parties
- Requiring third parties that work with PRM to adhere to all industry regulations, including those covered within national privacy regulatory requirements
- Limiting employee access to that which is required to perform the origination, processing and closing of mortgage transactions
- Protecting consumer data with appropriate firewall and Internet security measures
- Contracting with professional document shredding companies
- Maintaining secure facilities and office environments
